COURT HEARS HOW TWO MALE MEDICAL STUDENTS ‘FONDLED’ EACH OTHER IN LOCKED TOILET

A BAR-MAN narrated in the Lusaka Magistrate Court how he caught two male university medical students in Lusaka in the toilets fondling each other.

This was after he received informatio­n from one of his customers that the toilet door was locked and had an emergency of wanting to use it.

He said his customer told him that he rushed to the toilet to relieve himself but found the door locked, when he peeped through he saw two men fondling each other’s private parts.

This is in a matter in which the two students are charged with two counts of unnatural offences contrary to Section 155(a) of the Penal Code Chapter 87 of the laws of Zambia.

Brighton Banda, 25, of Avondale and Darius Musukwa, 20, of Kamwala South appeared before magistrate Amy Masoja who read the charge to them which they denied.

During the trial, a state witness, Benjamin Mwelwa told the court that while at work around 16:00 hours, Banda visited his bar for a drink.

“Mr Banda came for a drink at the bar, he bought a coke and went outside and after a few minutes a couple came in and also sat outside. I went to check on Banda whom I found with a friend, Musukwa and I asked what I could offer them and they said nothing,” he said.

Mr Mwelwa said he returned inside and a male customer followed him requesting to visit the toilets because he was not feeling well. “The customer went outside but came back and told me that the two men were not there and said they might be in the toilet and I should check, when I went to check I found the toilet locked and a man answered that he was peeing.

In the first count, it is alleged that Banda on February 24, in Lusaka, had carnal knowledge of Musukwa against the order of nature.

Trial continues on May 31.
