Man shot, wounded by police indicted on gun, drug charges

A was man indicted Friday after being shot and wounded by Dayton police last month, after he reportedly pointed a gun at two officers.

Eric Tyrone Grady Sr., 45, of Dayton is scheduled to be arraigned Thursday in Montgomery County Common Pleas Court for four counts of having weapons under disability and one count of possession of cocaine, all felony charges.

Dayton police were called twice the night of Aug. 23 to the 900 block of Custer Place, in the DeSoto Bass complex, on a report of a man with a gun. Two officers responded around 10:50 p.m. but did not find the armed man. The officers told witnesses to call 911 if the man returned, and they cleared the scene, Dayton Police Chief Kamran Afzal said previously during a media briefing.

The same two officers were dispatched at 11:36 p.m. after the man returned to Custer Place. The officers arrived at 11:37 p.m. and shortly thereafter video from one officer’s body-worn camera appeared to show the gunman, later identified as Grady, not comply with police commands to drop his weapon.

“Both officers discharged their firearms at the suspect after the suspect raised the firearm in their direction,” Afzal said.

One officer fired once and the second fired three times, the chief said.

Following the shooting, the officers rendered medical aid, and medics took Grady to a hospital for treatment of wounds described as not life-threatenin­g.

Police recovered two handguns at the scene. One that was reported stolen in Dayton had 46 live rounds in a drum-style extended magazine. The second had 12 live rounds in an extended magazine, Afzal said.

Grady was booked Tuesday afternoon into the Montgomery County Jail, online booking records show.

The two officers who fired their weapons are on paid administra­tive leave in accordance with department policy. Neither officer was named but both have been with the department for 18 months. Neither has any disciplina­ry records and one of the officers has a letter of commendati­on, Afzal said.

The Montgomery County Sheriff’s Office is handling the criminal investigat­ion and the Dayton Police Department will conduct an administra­tive investigat­ion.
